Francis P. Evans by his attorney complains of Westerfield McFadden, Chap McFadden and David McFadden of a plea of trespass, assault and battery.

For that the said defendants heretofore to wit on the ____ day of ____ 1850 on the Circuit aforesaid with force and arms to wit, with knives, sticks, and rocks, made an assault on the said plaintiff and him the said plaintiff then and there beat, illtreated and wounded in so much that his life was greatly despaired of and other injuries to him the said plaintiff then and there did, against the peace and diginity of the Commonwealth of Kentucky and to the damage of the said plaintiff ten thousand dollars therefore he sues.
